“Tribunal Europeo de Derechos Humanos y Corte Interamericana de Derechos Humanos: Comparación de Modelos y Experiencias”

La editorial Tirant lo Blanch publicó el libro “Tribunal Europeo de Derechos Humanos y Corte Interamericana de Derechos Humanos: Comparación de Modelos y Experiencias” (2019), editado por Roberto Romboli y Antonio Ruggeri. A continuación la presentación de la obra y su índice:

“El volumen Tribunal Europeo de Derechos Humanos y Corte Interamericana de Derechos Humanos: comparación de modelos y experiencias recoge las contribuciones y ponencias de la XI Jornadas de Derecho Constitucional italo-españolas-brasileñas celebradas en Mesina el 10 y 11 de septiembre de 2018, durante las cuales se reflexionó y se debatió sobre la relevancia que tiene la jurisprudencia de la Corte Europea de los Derechos Humanos y de la Corte Interamericana de los Derechos Humanos para los operadores jurídicos nacionales y, específicamente, para los jueces, y en qué medida la jurisprudencia de origen externo condiciona o ha condicionado la jurisprudencia interna. Participaron en las jornadas, a través de un debate profundo y dinámico a la vez, académicos, juristas y abogados de reconocido prestigio de los tres países, apareciendo en este volumen sus comunicaciones y ponencias en su lengua original. "How Human Rights Bodies Trigger the Application of Criminal Law"

En el último volumen de la Revista Utrecht Journal of International and European Law (Vol. 34, No. 2, 2018, pp. 161-184), se publicó un artículo de Mattia Pinto titulado “Awakening the Leviathan through Human Rights Law – How Human Rights Bodies Trigger the Application of Criminal Law. Este es el resumen del artículo: 

“This article analyses the role that human rights bodies play in triggering the application of criminal law. By examining the jurisprudence of the Inter-American Court of Human Rights, the European Court of Human Rights, the UN Human Rights Committee, as well as other human rights bodies, the article discusses how these institutions have started imposing on states positive obligations to criminalise, prosecute and punish serious human rights violations. While criminal law has traditionally been seen as a threat to fundamental rights, human rights bodies have contributed to presenting criminal law in a positive vein, as an essential instrument of human rights protection. The mainstream of the human rights movement has largely lauded the trend. This article challenges this view, by presenting the pitfalls of using human rights law to extend the reach of criminal justice in order to ensure that perpetrators are held accountable. Not only the imposition of duties to criminalise and punish ends up restricting the accused’s fundamental rights and neglecting the conceptualisation of criminal law as ultima ratio, but the invocation of criminal-law enforcement might also contribute to enhancing the coercive power of the state and, therefore, make state abuses more likely.”

The Interpretation of Human Rights according to International Treaties: Notes for their Jurisdictional Application in Mexico

Abstract: The reform of article 1 of the Political Constitution of the Mexican United States in June 2011, has incorporated into the constitutional text the clause of interpretation according to international treaties on human rights as the hermeneutic criteria which domestic judges must adopt in their verdicts. This clause reflects an evolutionary tendency which the Constitutional States are adopting, generating a new understanding of the state function as a whole, especially of the judiciary function. Despite this aperture, which enables the application of this type of hermeneutic techniques, it is possible to see how in some jurisprudential criteria a restraining posture is adopted towards international regulatory contents in human rights, leaving aside the possibility of an interpretative process of harmonization.

Human Rights and Judicial Dialogue between America and Europe: Toward a New Model of Law?

Abstract: In a context of progressive deterritorialization, the analysis of the judicial dialogue has certain profits when reformulating some aspects of a particular way of understanding the law, characterized by the principle of territoriality and by a theory of the sources of law in which the judge has a clearly secondary position in relation to the legislature and in which the sources are relevant since they are understood as explicit expression of a will. This paper describes the operability of the dialogue between the Inter-American Court of Human Rights and the European Court of Human Rights which, horizontally and voluntarily, can help create a context of community in relation to the contents of human rights, based on the recognition of the value of judicial arguments and the judge's self-understanding as members of a hermeneutical community. 

Reasonableness in the Concept of Reasonable Accommodation

Abstract: Reasonable accommodation is one of the pillars upon which the recognition of the rights of people with disabilities rests. It acquires its full meaning when understood in connection with the concept of universal design, since both concepts fall within the framework of universal accessibility. An accurate understanding of reasonable accommodation requires, on the one hand, clarifying its connection with universal design and accessibility, and on the other, unraveling what “reasonable” means. The reasonableness in accommodation takes to three kinds of reflections. On the one hand the one concerning non-discrimination, which requires to assess, when examining whether the adjustment is justified or not, if it entails a violation of the principle of equality (since it differentiates or it does not, in an unjustified manner, thus harming a human right such as accessibility). In this justifying test there is an essential methodological tool at hand, which shall be regarded as the second great reflection on reasonableness in accommodation: the principle of proportionality. In virtue of this principle, the reasonableness test requires facing the adjustment’s adequacy and necessity and, in addition to that, the advantages or sacrifices that produces on rights. And since both of these reflections do not ensure a single answer, reasonableness requires a last reflection on the basis of acceptability. The adjustment’s justification, or the lack of it, shall be subject to the community’s acceptance or rejection. 

The Role of Social Movements in the Recognition of Gender Violence as a Violation of Human Rights: From Legal Reform to the Language of Rights

Abstract: The history of rights shows that the struggle for the recognition of women’s rights was difficult enough and the recognition of the right of women to a life without gender violence has been even more difficult. With a perspective based in a socio-legal and critical approach, this article defends that the recognition of the right of women to a life free of gender violence must be seen as a conquest of the feminist movement and women’s organizations. It was the struggle of the feminist movement which provided the catalyst for the recognition of women’s rights and the specific right of women to a life free of gender violence and to protection against such violence. But not only the recognition, also the praxis of the right of women to a life free of gender violence is important. The right of women to a life free from gender-based violence cannot be fully realized without the implementation of this right at the international and the local level. The implementation of rights and the existence of social movements involved with the right to a life free from gender violence is decisive to transforms the demands for protection from violence and its eradication to be see not as a question of mercy, but as a question of justice; and putting the individual experiences of gender violence victims within a wider framework from which the abuse can be considered as a social problem.

La legitimidad como elemento crucial de la efectividad de pronunciamientos de la Corte Interamericana de Derechos Humanos ante casos complejos y desafíos regionales

Resumen: “Sin la Corte Interamericana de Derechos Humanos, numerosas personas se habrían visto desprotegidas en la región: tanto aquellas con derechos ultrajados que acudieron al sistema y vieron sus casos resueltos por la Corte, como aquellas sujetas a la jurisdicción de Estados que han cambiado y mejorado sus prácticas y normas de conformidad con la jurisprudencia de la Corte. Analizando la importancia del trabajo de la Corte en las dimensiones tutelar y constitucional y sus límites, se examinan preocupantes manifestaciones potenciales de rebeldía que pueden menoscabar la eficacia o competencia de la Corte y generar la indefensión de muchas víctimas, por lo que se identifican aspectos clave de su legitimidad y se sugieren mecanismos de publicidad, revisión y análisis de casos complejos para fortalecer a la Corte y garantizar su legitimidad y capacidad de proteger a víctimas en la región”.

Una cuestión de apreciación: el margen de apreciación en la Corte Interamericana de los Derechos Humanos

Resumen: “Toda discusión sobre el futuro o la reforma del sistema interamericano debe partir de tres ejes esenciales. Primero, la reforma de la Comisión Interamericana de Derechos Humanos (‘CIDH’) en cuanto a su rol cuasi-jurisdiccional y delimitar sus atribuciones en cuanto a órgano político y órgano que participa en la actividad jurisdiccional del sistema. Segundo, la reforma estructural de la Corte Interamericana de Derechos Humanos (‘Corte IDH’), en cuanto a la posibilidad de aumentar la matrícula de jueces y así considerar la opción de poder dividir a la corte en salas y que el pleno pueda decidir en atribuciones de alzada. Tercero, considerar la posibilidad de que la Corte IDH se incline por el margen de apreciación, pero no en la forma incierta como ha sido adoptada por la Corte EDH, sino bajo un prisma convencionalmente adecuada para evitar que la discreción se convierta en arbitrariedad. En efecto, la Convención Americana sobre Derechos Humanos crea bases relativamente homogéneas entre los Estados parte, ya que, a pesar de las diferencias, comparten elementos que identifican a cualquier estado democrático y republicano. Pero, aun en las similitudes generadas, el Estado actúa para responder a su realidad. El margen de apreciación es la deferencia a favor del Estado respecto a tensiones generadas por realidades jurídicas-sociales. En el presente trabajo abordaremos en qué consiste el margen de apreciación como deferencia judicial, particularmente en la práctica jurisdiccional en el derecho internacional de los derechos humanos en los sistemas europeo e interamericano, respectivamente. Finalmente, veremos a qué objeciones se enfrenta el margen de apreciación nacional, y qué pasos deben ser dados para aprender de las debilidades del concepto europeo del margen de apreciación para así adoptar una teoría convencionalmente adecuada del mismo, en el cual se admita un espacio de deferencia para las actuaciones del Estado, pero sin que dicha discreción a favor del Estado suponga vaciar de contenido a la CADH." 

Los límites del Sistema Interamericano: denuncias y amagos como respuesta al impacto de la jurisprudencia de la Corte

Resumen: “Las denuncias de la CADH por parte de Trinidad & Tobago y de Venezuela constituyen una prueba del impacto de la jurisprudencia de la CorteIDH, así como ponen en tela de juicio un sistema ya de por sí cuestionado. A estas denuncias efectivas han de añadirse la pretendida de Perú, las intenciones manifestadas por Ecuador y el pronunciamiento del Tribunal Constitucional de la República Dominicana, que ha declarado inconstitucional la aceptación de la jurisdicción de la CorteIDH. Este artículo tiene como objetivo analizar las causas subyacentes a estas reacciones estatales en un escenario, no exclusivo del Sistema Interamericano, que constituye una amenaza para los principales avances del proceso de internacionalización de los derechos humanos”.
